Call io Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is an integral, inseparable, and legally binding part of the Terms of Service and is incorporated into the Terms by reference. This AUP governs your access to and use of the Platform and Services and constitutes a binding agreement between you (referred to herein as “the Customer”, “User”, “you” or “your”) and Getverify LDA, a company incorporated under the laws of Portugal, located at Avenida do Infante, no. 50, 9004-521 Funchal, Madeira, Portugal and where applicable its subsidiaries, affiliates and related corporations (referred to herein as “Call io”, “the Company”, “we”, “us” or “our”), concerning your access to and use of Call io’s Services via Call io website, related features and services, and other linked channels, mobile websites or applications (collectively, the “Platform”). By accessing or using the Platform or Services, you acknowledge that you have read, understood, and agreed to be bound by this AUP in addition to the Terms of Service.

For purposes of this Acceptable Use Policy, capitalized terms not otherwise defined herein shall have the meanings assigned to such terms in the Terms of Service.

1. Scope and General Principles

1.1. This policy applies to all access to and use of the Platform and Services, including all call-answering behaviour, call-handling actions, AI Assistant interactions with callers, instructions submitted through the Platform, and all Assistant Outputs generated during forwarded inbound calls.

1.2. Call io is an AI-powered inbound call assistant that processes forwarded calls from the User’s mobile operator line. The Services use third-party AI Providers and Telco Partners to deliver call-handling functionality, including answering, interacting with callers, generating summaries, and applying call-management rules. Call io does not provide APIs for third-party model integrations and does not allow Customers to access or fine-tune Models directly.

1.3. You remain fully responsible for all caller data, call-forwarding settings, instructions, call-management rules, and other content or configurations submitted through your account, as well as for all outputs generated by the AI Assistant on your behalf.

1.4. You must not use the Services in any way that would cause Call io, its affiliates, or any Third-Party Provider to be in breach of applicable law, their own policies, or regulatory requirements.

1.5. You are solely responsible for providing any legally required notices, warnings, or disclosures to callers, including informing callers that their call is being answered by an AI-based assistant where required under Applicable Law.

2. Illegal, Harmful, and Abusive Use

2.1. You must not use the Platform or Services to violate any applicable law or regulation, including those relating to data protection, export control, sanctions, consumer protection, financial crime, or AI safety.

2.2. You must not generate, upload, or distribute content that is illegal, harmful, deceptive, defamatory, harassing, discriminatory, hateful, incites violence, or otherwise violates the rights or safety of any person or group.

2.3. You must not generate or distribute content that exploits or endangers minors, including sexual content involving minors, sexualization of minors, or any depiction of child abuse.

2.4. You must not generate, upload, or distribute non-consensual sexual content or intimate imagery, including synthetic media depicting real persons in sexual or compromising contexts without explicit and provable consent.

2.5. You must not engage in harassment, stalking, doxxing, threats, or targeted abuse of individuals or groups.

2.6. You must not promote self-harm, suicide, or dangerous activities without appropriate harm-reduction context.

2.7. You must not use the Services to forward, process, or receive calls to or from any country, region, or territory that is subject to trade restrictions, telecommunications restrictions, embargoes, or sanctions under Applicable Law, including but not limited to jurisdictions listed by the EU, OFAC, or the United Nations. Call io may block or restrict calls to certain geographic areas where required by law or where necessary for fraud-prevention or network-security purposes. Call io may disable forwarding into those regions automatically.

2.8. You must not use the Services for any illegal or fraudulent conduct carried out through phone interactions, including but not limited to impersonation of government officials, phishing, social-engineering, fraudulent solicitation of money or information, unlawful debt collection, spam or robocalling, or any conduct designed to mislead, manipulate, or deceive callers.

2.9. You must not use the Services for unlawful telemarketing, unsolicited commercial communications, spam calling, auto-dialing, lead-generation schemes, or any activity regulated under telemarketing, robocall, or consumer-protection laws without all legally required consents and disclosures.

2.10. You must not use the Services in connection with illegal industries or activities, including illicit drug trade, human trafficking, unauthorized gambling operations, money laundering, unlicensed financial services, or any activity that is unlawful in the jurisdiction where the call is placed or received.

2.11. You are responsible for ensuring that your use of call-forwarding, call-handling features, and AI Assistant interactions complies with the laws of both (i) the jurisdiction where the caller is located and (ii) the jurisdiction where you are located. Where there is a conflict, the stricter legal requirement applies.

3. Intellectual Property, Personality Rights, and Sensitive Data

3.1. You must not infringe or misappropriate intellectual property rights, including copyrights, trademarks, patents, trade secrets, or database rights.

3.2. You must not generate or use content that imitates or misuses third-party brands, logos, trade dress, product designs, or copyrighted characters in a manner likely to cause confusion, imply sponsorship, or infringe rights without demonstrable permission.

3.3. You must not create synthetic media or deepfakes that imitate an identifiable person without provable and legally valid consent.

3.4. You must not submit or process personal data in violation of applicable data protection laws, including data processed without a lawful basis or without required disclosures or transfer safeguards. You shall not instruct the AI Assistant to solicit or collect such data during calls.

3.5. You must not submit or process special categories of personal data, including health data or biometric data, unless clearly permitted under applicable law and supported by appropriate consents and safeguards.

4. High-Risk and Regulated Uses

4.1. You must not rely on the Services as the sole or primary system for medical diagnosis, treatment, triage, or decisions that may affect health or physical safety.

4.2. You must not rely on the Services for legal, financial, tax, investment, or regulatory advice where professional qualifications are required or where reliance may cause material harm.

4.3. You must not use the Services in critical infrastructure, emergency response, weapons systems, or environments where malfunction may result in death, injury, or substantial property damages.

4.4. You must not use the Services for automated decision-making that produces legal or similarly significant effects on individuals without required human oversight and transparency.

4.5. If you use the Services in regulated or high-risk contexts, you must implement human review, validation, and control and remain solely responsible for outcomes. You must not use the Services to make eligibility determinations, credit decisions, hiring decisions, or insurance decisions.

5. Security, Abuse, and Technical Misuse

5.1. You must not bypass, disable, or interfere with authentication, rate limits, usage limits, or other access controls.

5.2. You must not probe, scan, or test the vulnerability of the Platform or related networks without prior written consent.

5.3. You must not develop or distribute malware, spyware, ransomware, exploits, or code intended to damage or gain unauthorized access to systems.

5.4. You must not generate excessive or abusive volumes of automated traffic or degrade system performance.

5.5. You must not engage in credential attacks, scraping of confidential information, or attempts to gain unauthorized access to data or systems.

5.6. You must not manipulate billing, or usage metrics, including by spoofing traffic or simulating usage to obtain financial benefit.

5.7. You must not use the Services to spoof, mask, manipulate, or falsify caller identification, call-forwarding information, call routing, or any telecommunications signaling in a manner that misleads callers, mobile operators, or regulatory authorities.

6. Use of Assistant Outputs

6.1. Assistant Outputs may be inaccurate, incomplete, or biased. You are responsible for independently reviewing and verifying outputs before relying on or publishing them.

6.2. You must not use outputs in a manner that misleads others about their nature or origin, including presenting AI-generated content as human-generated where doing so may deceive or cause harm.

6.3. You must not use the Services to train or improve competing platforms or models that provide substantially similar functionality unless expressly authorized in writing by Call io.

6.4. You must not attempt to circumvent, disable, or manipulate safety systems, content filters, or policy enforcement mechanisms.

6.5. The AI Assistant must not mislead callers into believing it is a human unless expressly permitted under Applicable Law. You must ensure that callers receive any legally required notices regarding the use of an AI-based call assistant. This includes any jurisdiction that requires disclosure at call start.

7. Monitoring and Enforcement

7.1. Call io may monitor use of the Services to detect security issues, abuse, or policy violations.

7.2. Call io may, without notice and without liability, restrict or revoke access to certain AI Providers or Service features, block call traffic, limit AI Assistant functionality, suspend or terminate accounts, or report violations to Third-Party Providers or authorities.

7.3. Enforcement decisions may be based on confidential risk assessments or obligations that cannot be fully disclosed. You waive objections based solely on nondisclosure of internal rationale.

7.4. No suspension or termination under this policy creates an obligation for Call io to refund any fees or extend your Subscription Period.

8. Liability and Indemnity

8.1. You bear full responsibility and liability for all data, prompts, inputs, instructions, requests, model outputs, and other content submitted, generated, transmitted, or used through your account, whether performed by you.

8.2. You acknowledge that Call io is not responsible for the legality, accuracy, quality, safety, reliability, or appropriateness of any content or model outputs generated or used through the Services. You assume all risks arising from your reliance on or use of any such content or outputs and remain solely responsible for any consequences arising from their publication, modification, storage, or further processing.

8.3. You agree to indemnify, defend, and hold harmless Call io, its affiliates, directors, officers, employees, agents, authorized service providers, and any entity acting as merchant of record or reseller for Call io, together with their respective personnel, from and against all claims, damages, liabilities, penalties, fines, regulatory actions, and costs including reasonable legal fees and expenses, arising out of or related to:

8.3.1. Your use of the Platform or Services;

8.3.2. your publication, distribution, reliance on, or further processing of model outputs or other content;

8.3.3. any breach of this Acceptable Use Policy or the Terms of Service;

8.3.4. any violation of applicable law or third-party rights, including intellectual property, privacy, data protection, and personality rights;

8.3.5. any act or omission by any person who uses your Call io account with or without authorization,

8.3.6. any dispute, chargeback, complaint, or regulatory inquiry arising from transactions processed through an entity acting as merchant of record or reseller on behalf of Call io.

8.4. Call io, its affiliates, or any merchant of record or reseller may, at their discretion and at your expense, assume the exclusive defense and control of any matter subject to indemnification under this Section. You may not settle or resolve any such matter without the prior written consent of Call io or the relevant merchant of record or reseller, as applicable.

8.5. This Acceptable Use Policy supplements, and does not limit, replace, or restrict any indemnification, warranty disclaimer, or limitation of liability provisions contained in the Terms of Service. In the event of overlap, the stricter provision shall apply to the extent permitted by law.

8.6. All obligations under this Section survive termination, suspension, or expiration of your access to the Platform or Services.

9. Changes to this Policy

9.1. Call io may update this policy at any time by publishing the updated version on the Platform.

9.2. Continued use of the Platform after publication constitutes acceptance. You are responsible for reviewing and relying on the current version.
